On March 25, 2020, the U.S. Department of Energy (DOE) announced a meeting of the Biological and Environmental Research Advisory Committee (BERAC). The meeting will be held digitally via webcast on April 16, 2020, from 9:00 a.m. to 5:00 p.m. (EDT). Information on how to access the meeting will be posted here. Tentative agenda topics include:

  • BERAC business and discussion;
  • News from the Biological Systems Science and Climate and Environmental Sciences Divisions;
  • News from the Office of Biological and Environmental Research (BER);
  • Report brief(s); and
  • Public comment.

The virtual meeting is open to the public. Both written and oral statements regarding agenda items will be accepted.

On February 3, 2020, the U.S. Department of Agriculture (USDA) Agricultural Marketing Service (AMS) published a notice requesting comments and feedback on its draft instructions on testing methods under the National Bioengineered Food Disclosure Standard (Standard). According to the Standard, which became effective in 2019, with a mandatory compliance date of January 1, 2022, foods that do not contain bioengineered (BE) material do not require label disclosure. USDA’s definition of BE food (7 CFR 66.1) states that food does not contain modified genetic material if the genetic material is not detectable. Therefore, detectability testing for BE materials in foods plays a key role for stakeholders to determine labeling compliance. Given its importance, USDA AMS has drafted instructions on acceptable testing methodology to be used to satisfy the requirement that the food does not contain detectable BE material. Detectability testing must meet the following standard:

  • Laboratory quality assurance must ensure the validity and reliability of test results;
     
  • Analytical method selection, validation, and verification must ensure that the testing method used is appropriate and that the laboratory can successfully perform the testing;
     
  • The demonstration of testing validity must ensure consistent, accurate analytical performance; and
     
  • Method performance specifications must ensure that analytical tests are sufficiently sensitive for the purposes of the detectability requirements of this part.

Comments on USDA AMS’s draft instructions must be submitted on or prior to March 4, 2020.

On January 23, 2020, the U.S. Department of Energy (DOE) announced the availability of more than $96 million in funding for bioenergy research and development (R&D) in support of the U.S. bioeconomy. DOE’s funding efforts also align with its own goal to provide secure, affordable, and reliable domestic energy options for consumers and business. This funding opportunity announcement (FOA) aims to advance DOE’s Bioenergy and Technology Office’s (BETO) objectives of: (1) reducing the price of drop-in biofuels; (2) enabling high-value products from biomass or waste resources; and (3) lowering the cost of biopower. Topic areas within this FOA include:

  • Up to $8 million for scalable carbon dioxide (CO2) electrocatalysis technologies for generating chemical building blocks;
  • Up to $14 million for algae bioproducts and CO2 direct-air-capture and efficiency;
  • Up to $28 million for scale-up of bench applications of biofuel and bioproduct processes;
  • Up to $5 million for low-emission, high-efficiency residential wood heaters;
  • Up to $18 million for waste to energy strategies for a bioeconomy, including strategies for municipal solid waste, wet wastes, and municipal wastewater treatment;
  • Up to $15 million for biopower and products from urban and suburban wastes (North American Multi-University Partnership for Research and Education), with a focus on using plastic waste to make recycled products and to produce low-cost biopower; and
  • Up to $8 million for bio-restore -- biomass to restore natural resources -- to quantify the economic and environmental benefits associated with growing energy crops, with a focus on restoring water quality and soil health.

According to DOE’s FOA, the application process will consist of two phases: a concept paper and a full application. Phase one of the process (the concept papers) are due on March 5, 2020, and phase two (full applications) are due on April 30, 2020. Further details are available here.

On December 10, 2019, the U.S. Department of Energy (DOE) Office of Energy Efficiency and Renewable Energy (EERE) Bioenergy Technologies Office (BETO) published a notice of intent to issue a joint Funding Opportunity Announcement (FOA) with the Advanced Manufacturing Office (AMO), titled “BOTTLE: Bio-Optimized Technologies to Keep Thermoplastics out of Landfills and the Environment.” This FOA supports the Department’s Plastics Innovation Challenge, a comprehensive program to accelerate innovations in energy-efficient plastics recycling technologies by supporting high-impact research and development for plastics. The primary goal of the FOA is to develop new bio-based plastics that are capable of efficient recyclability and developing improved recycling strategies that can break down existing plastics into chemical building blocks that can be used to make higher value products.

From December 11 through 12, 2019, DOE’s Office of Bioenergy Technologies Office will host a workshop titled “Plastics for a Circular Economy” in Denver, Colorado. The workshop will include discussions on technology solutions to address plastic waste and focus on the development of new recycling and degradation strategies. The objective of the workshop will be to identify early-stage applied research problems in the aforementioned area that need to be addressed both in the long- and near-term. Representatives from waste management facilities, circular economy experts, commercial plastic producers, and biobased plastic innovators will be some of the participants.

On October 2, 2019, the government of Quebec, Canada, published in its Official Gazette a notice of a draft regulation setting standards for the integration of renewable fuels into gasoline and diesel fuel.  Under the draft regulation, the standards will apply on July 1, 2021, and will then increase. As of July 1, 2025, the integration of a minimum volume of ethanol of 15 percent into gasoline and a minimum volume of biobased diesel fuel of 4 percent into diesel fuel will be required. Given the evaluation by the Canadian government of this matter, the notice states that the proposed regulation would have no particular impact on small and medium-sized businesses because the petroleum products distribution sector is made up of large businesses.  Also on July 1, 2025, enterprises subject to the regulation will invest a total of 110 million Canadian dollars in infrastructure to comply with the set standards for the integration of renewable fuels into gasoline and diesel fuel.


 

The Product Stewardship Society (PSS) Board of Directors inducted Lynn L. Bergeson as President during its annual board meeting preceding the Product Stewardship conference being held in Columbus, Ohio, September 10-12, 2019. Ms. Bergeson, Managing Partner of Bergeson & Campbell, P.C. (B&C®), will serve as President through 2021. Ms. Bergeson has served on the PSS Board of Directors since 2015.

PSS is an affiliate of the American Industrial Hygiene Association (AIHA®), launched in 2012 to drive the product stewardship profession forward by providing resources, professional development, and networking opportunities that serve the needs of professionals globally. PSS and AIHA announced in late 2018 the joint development of an ANSI-certified product stewardship credential, and progress toward the launch of the test-based credential continues in 2019. PSS recently published Professional Practices of Product Stewardship, a first-of-its-kind textbook providing deep insight into core areas of product stewardship, including product risk management, product life cycle management, management of product compliance and liability, and product stewardship strategy and program management. Other PSS publications include Realizing the Full Business Value of Product Stewardship, for which Ms. Bergeson authored the chapter “Legal Considerations Relating to Tort and Product Liability Law,” and Core Competencies for the Product Stewardship Professional. On May 28, 2019, the U.S. Department of Energy (DOE) Office of Energy Efficiency and Renewable Energy’s (EERE) Bioenergy Technologies Office (BETO) announced that, in partnership with its National Laboratories, it is dedicating the months of May and June to the public exploration of renewable biomass feedstocks used for the production of biofuels, bioproducts, and biopower in support of the U.S. bioeconomy. This means that during the months of May and June 2019, BETO will be sharing information on “Bioenergy Feedstocks Out Your Window” via social media and offering webinars on new research. The June webinars will focus on research strategies that enable supply-chain improvements in biomass quality and consistency through blending, preprocessing, diversity, and landscape design in development of conversion-ready, lignocellulosic feedstocks for production of biofuels, biopower, and bioproducts.
